Immigrant VisasEmployment-Based Sponsorship
The procedure for an employment-based sponsorship generally involves the following three steps:
- PERM Alien Employment Certification Application
- I-140 Immigrant Visa Petition
- I-485 Adjustment of Status Application or Consular Processing
Not all employment-based sponsorships require a filing of labor certification application with the DOL. Foreign nationals who qualify under the following classifications are exempted from filing the labor certification application:
- Alien of Extraordinary Ability (EB1)
- Outstanding Professor or Researcher (EB1)
- Multinational Executive or Manager (EB1)
- National Interest Waiver (EB2)
- Schedule A Occupations: Professional Nurses, Physical Therapists, etc.
- Immigrant Investor (EB5)
