EMPLOYMENT AUTHORIZATION

Foreign students generally cannot engage employment unless it is authorized by the school and receives INS Employment Authorization Document (EAD) to work.

Foreign students may apply for EAD under any one of the following conditions:

  • Economic distress
  • Curricular Practical Training (arranged with the school as part of the student's curricular training - such as co-op) ** If the student uses up to 12 months of curricular practical training, s/he will lose the eligibility to obtain Optional Practical Training at the end of the study.
  • Optional Practical Training (OPT) - upon completion of the study, an F-1 is eligible for one year employment authorization which permits the student to engage employment in the field related to his/her study.

An employer who is interested in continuing the foreign student's employment beyond OPT must file an H-1B visa petition at least 6 months prior to the expiration of the OPT to ensure employment without disruption.
