TN VISA APPLICATION. NORTH AMERICAN FREE TRADE AGREEMENT (NAFTA)

For CANADIAN NATIONALS:

  • TN application can be applied directly at the port of entry, US international airport or preflight inspection station. The application should contain the following:
    • Evidence of citizenship (passport or birth certificate)
    • Evidence that the applicant meets the minimum job requirements
    • Employment letter setting forth detailed job description, length of employment, summary of the applicant's education and/or experience, and remuneration for the services rendered.
  • Employment is granted for a period of up to one year.
  • Employment can be renewed indefinitely for one year each time.
 
For MEXICAN NATIONALS:

  • Must file I-129 Visa Petition with CIS Northern Service Center even in emergent situations. The visa petition should contain the following:
    • Evidence of citizenship (passport)
    • Certified ETA9035 Labor Condition Application
    • Evidence that the applicant meets the minimum job requirements
    • Employment letter setting forth detailed job description
  • Once the Visa Petition is approved, the applicant will be able to apply for a TN visa with an American consulate to enter the US.
  • Employment is granted for a period of up to one year.
  • Employment can be renewed indefinitely for one year each time.
  • Must file amended I-129 TN Visa Petition to advise the CIS of any changes of terms and conditions of the employment that will affect the applicant's eligibility in remaining in a TN status.
  • Must notify the CIS if the applicant is terminated prior to the expiration of the status
